Terms and Conditions for Cristian Jirau Martir

Welcome to Online Mixing & Mastering by Cristian Jirau Martir. By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions.
1. Services
‣ Cristian Jirau Martir provides online mixing and mastering services for independent artists, bands, and other clients in the music industry.
‣ Freelancer uses industry-standard techniques and tools to deliver high-quality results per the Client’s specifications. Services are delivered digitally unless otherwise specified.
2. Service Requests and Deliverables
‣ All service requests must be submitted through our website or via agreed-upon communication channels.
‣ Clients must provide all necessary materials required for the project, including:
● Raw audio files
● Reference tracks
● Project notes
Any specific requests before work begins
Clients must ensure files are correctly formatted:
● Format: WAV
● Sample Rate: 48kHz
● Bit Depth: 24-bit
‣ Revisions are based on the package selected and must be requested within [number] days of delivery. Additional revisions or mix/track substitutions beyond the included revisions may incur extra fees.
‣ Final deliverables will be provided in WAV and MP3 formats via WeTransfer unless otherwise specified.
‣ Clients are responsible for downloading and backing up all files upon receipt, as Freelancer is not responsible for long-term storage.
‣ Delays in providing materials may result in adjusted delivery timelines.
3. Payment Terms
‣ A non-refundable deposit of 50% is required before work commences.
‣ The remaining 50% is due upon completion and before delivery of final files.
‣ Accepted payment methods: Paypal, Venmo, Zelle, Bank Transfer.
‣ Additional revisions, track replacements, or special requests beyond the agreed terms may incur extra fees.
4. Revisions
‣ Mastering Package: Includes 3 free revisions. Any additional revisions beyond the included 3 will incur a fee of $20 per revision.
‣ Mixing Package: Includes 4 free revisions. Any additional revisions beyond the included 4 will incur a fee of $25 per revision.
‣ Revisions must be requested within [2] days of receiving the delivered work. Requests after this period may be subject to additional fees or may not be accommodated.
5. Intellectual Property / Ownership
‣ This is a Work for Hire arrangement. Upon full payment, the master recording will have the following ownership split:
● Engineer: 25% ownership of the final master recording. This ownership does not extend to the underlying musical composition unless mutually agreed in writing.
● Client: 75% ownership of the final master recording.
‣ Any revenue generated from the exploitation of the master recording (including, but not limited to, streaming, synchronization, and licensing) will be split according to these percentages.
‣ Credit: The Engineer will be credited as “Mixing Engineer” and/or “Mastering Engineer” on all official releases.
‣ Portfolio Usage: Cristian Jirau Martir retains the right to use portions of the work for portfolio and promotional purposes unless otherwise agreed in writing.
6. Client Responsibilities
‣ Clients agree to:
● Provide all necessary materials before work begins.
● Ensure files are correctly formatted (WAV, 48kHz, 24-bit) and delivered on time.
● Respond to communications and revision requests within agreed-upon timeframes.
● Clearly communicate expectations or specific requirements to avoid unnecessary revisions.
● Approve final work and complete any remaining balance before receiving the final deliverables.
‣ Failure to meet these responsibilities may result in adjusted delivery timelines.
7. Limitation of Liability
‣ Cristian Jirau Martir is not liable for any indirect, incidental, or consequential damages.
‣ While high-quality results are ensured, we cannot guarantee chart placements, downloads, streams, or financial outcomes.
8. Cancellation & Refund Policy
‣ Deposits are non-refundable.
‣ If the client cancels after work has begun, the deposit is retained.
‣ If Cristian Jirau Martir cannot complete a project due to unforeseen circumstances, a prorated refund will be issued based on work completed.
9. Independent Contractor Status
‣ Cristian Jirau Martir operates as an independent contractor, not an employee, partner, or agent of the client.
10. Confidentiality
‣ Confidentiality Obligation: Both parties agree to keep confidential all proprietary information shared during the course of their working relationship. This includes, but is not limited to, project details, audio files, business information, and any other data that is not publicly available.
‣ Non-Disclosure: The Engineer agrees not to disclose any confidential information to any third party without the express written consent of the Client. This includes, but is not limited to, sharing audio files, project concepts, or client-related information.
‣ Exclusions: Confidential information does not include information that:
● Is already publicly available.
● Is disclosed to the Engineer by a third party legally entitled to do so.
● Is independently developed by the Engineer without reference to the Client’s confidential information.
‣ Term of Confidentiality: The confidentiality obligations remain in effect for 6 months following the completion of the project or termination of the working relationship, whichever is later.
11. Governing Law
‣ These Terms and Conditions are governed by the laws of California, USA, without regard to conflict of law principles.
‣ Any disputes will be subject to the exclusive jurisdiction of the courts in California.
12. Changes to Terms
‣ Cristian Jirau Martir may update or modify these Terms at any time.
‣ Clients and website visitors are encouraged to review this page periodically.
